1. Agreement to Terms

By accessing this website or engaging FalconMVP ("Company", "we", "our") for services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our website or services.

2. Services

FalconMVP provides software development, MVP design, consulting, and related digital services. All services are delivered based on the scope, timeline, and pricing agreed upon in writing prior to project commencement.

3. Payments & Deposits

All projects require an upfront deposit before work begins. Deposits are non-refundable. Remaining balances must be paid according to agreed milestones. Failure to make payments may result in paused or terminated services.

4. Scope of Work & Revisions

Services are limited strictly to the agreed scope. Any requests outside the original scope will be treated as change requests and may require additional fees and timeline adjustments. Revisions are limited to what is explicitly included in the agreed scope.

5. Intellectual Property

Upon full payment, the client receives ownership of the final delivered work, excluding third-party tools, libraries, or pre-existing frameworks. FalconMVP retains the right to showcase completed work for portfolio and marketing purposes unless otherwise agreed in writing.

6. Client Responsibilities

Clients agree to provide timely feedback, approvals, and required materials. Delays caused by the client may affect delivery timelines and do not constitute breach of contract.

7. Disclaimer

Services are provided “as is.” FalconMVP does not guarantee specific business outcomes, user growth, revenue, or funding results. Software development involves inherent risks, and the client assumes responsibility for business decisions made using the delivered product.

8. Limitation of Liability

In no event shall FalconMVP be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the total amount paid by the client for the services giving rise to the claim.

9. Termination

Either party may terminate services with written notice. Work completed up to the termination date remains payable. Deposits are non-refundable.

10. Modifications

FalconMVP reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of the revised terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. You irrevocably submit to the exclusive jurisdiction of the courts in that location.
